Mistral Design and Management Ltd. will provide drawings for the specific stated purpose indicated by the Client based upon an inspection carried out or drawings and other information provided by the Client, within the limitations defined below or any additional limitations and identified and informed in writing to the Client.

Site inspection and measurements.

Mistral Design and Management Ltd. will inspect the site and take such measurements and make such inspections as are appropriate within the following limitations:

Measurements – where measurements are taken these will be to the surface finishes, or where appropriate, the centre line of elements of the property or the structure of the property.  All measurements will be taken standing at ground level outside of the buildings and by standing at floor levels within any buildings. Adjustments will not be made for sloping surfaces

 

Levels – unless specifically requested, levels will not be taken.

 

Services – except where specifically instructed to do so, no part of the structure or access point will be opened up in order to reveal the whereabouts and levels of any services.

 

Areas not inspected – professional experience and expertise will be used as appropriate to deduce the form of construction and the thickness of elements of construction and of materials incorporated within the subject property.  Where no access is available this will be drawn to the Clients attention and measurements in respect of those parts will be estimated or deduced.

Drawings and information provided by others.

Where plans and other information have been made available by the Client and or others upon which to base the drawings, they will be solely relied upon for accuracy and information provided. The Client is responsible for ensuring that no breach of copyright arises out of their instruction to trace or copy drawings and information provided by them.

Dimensions.

All dimensions must be checked on site and not scaled from the drawing.

Orientation.

North points shown are for approximate orientation purposes only.

Title deeds.

Unless specifically requested to do so, the title deeds will not be examined to establish the correct position of the boundaries of the site.

Ordnance Survey Copyright.

The Client will be responsible for all fees in respect of Ordnance Survey Copyright

Confidentiality and Copyright.

The drawings are prepared solely for the use of the named Client and their professional advisors and for the specific stated purpose only.  No responsibility is accepted whatsoever to any other party. Neither the whole or any part of the drawing nor any reference thereto may be included in any published document, circular or statement in any way without the prior written approval of the form and context in which it might appear of Mistral Design and Management Ltd. Unless otherwise agreed in writing by Mistral Design and Management Ltd, shall retain copyright in and ownership of all drawings and plans etc.

Accuracy & Equipment. 

Mistral Design and Management Ltd. will provide measuring tapes and other equipment required to take measurements to the accuracy appropriate to the instruction.  Where levels and other accurate calibrated measuring equipment is required the cost will be payable by the Client.

Fees and expenses.

The Client will pay Mistral Design and Management Ltd. the agreed fee and disbursements upon delivery to the Client of completed plans and drawings or as otherwise agreed. The current level of disbursements is 10% of the agreed fee.  This includes printing, postage and ordnance survey maps but does not include exceptional items such as courier service, feasibility studies and fees associated with requests to discharge planning conditions.
